18 - wheeler hits windsheild?

a truck driver for a very well set comapny either threw something off his truck or threw something out the windowpane. It broke my windsheild , I have a police report and tried to make the company compensate but they say it's road hazard. How do I politly explain that if he threw something out the skylight how can it be road hazard. I actually didn't see him throw something but his windowpane was down how do I explain that to the truck drivers insurance company that I have to phone ? Do I have rights to make them pay envelope if he did throw something even if he didn't it's questionable. (right)

You do not state it be a rock, or a tv set, or whatever that broke your window, and you read aloud you didn't see him throw anything, so what possibly makes you think you can prove he sit and waited for you to get close later threw something at you? Where's the weapon? Where are the fingerprints? Witnesses, video, crime scene reconstruction?

Also, if it was a semi trailer at the back a tractor, if it was a van, the projectile would have to enjoy to have been thrown from underneath a tire, thus becoming a road hazard. Unless the trailer had blown a tire, afterwards if you had a piece of the blown tire, it would be the responsabity of the trucking co. If the trailer was a unfold top trailer (end dump, etc.) and did not have a cover over the load next you DO have a claim if you can prove a few things. You must supply the time of day, the road you be on, the direction you were taveling the nearest street (intersection on/off ramp) and the number on the trailer (either the license plate or the co. number). Without this info, You don't have much casual to collect. If you have this info you can ask the trucking co. to provide you with compensation or the pet name of their ins. co. if they refuse to give you the information you can return with the operating authority number (DOT# and or State PUC/PSC#. You can then get the phone # from information and contact the agency and go and get the number of the insurance co. of record. But if you don't have the info programmed above. you are SOL. Like for example, X was driving a pickup carrying load of furniture when a rope broke and a table flew past its sell-by date, right into your car. In this case, it's observable it came off his vehicle.

In your crust, you don't seem to have the purpose, you can't prove it came off of his truck. Could be a rock kicked up by someone from the other side of the freeway for adjectives you know. Sorry, you don't have a case.
