They were found at blame. Their insurance only requests to pay 70%. So I bursting with my insurance who is paying 100% minus my 500 dollar deductible. My insurance the other daytime told me if they other company calls me trying to procure me to except the 70% not to take our they won't be capable of go after them for reimbursement. But this have been a strain from both insurance companies in my ***. Neither will settle for my rental car I'm out 500 bucks that be christmas money and the accident wasn't my denounce nor was I given any tickets.
Now my piece if I take the 70% I find 1600 and I can pocket 1100. Say bite me to both of them. I feel I earn it.
Answers: like the others said, you cant grasp paid twice, it is risky;
right now you are out your $500 deductible and rental; technically you are owed 70% of your rental since they are singular accepting 70% liability; but dont take that contribute; i am guessing that you dont have rental on your policy, or your company would own paid;
right immediately both companies are disputing liability; your company wants 100% to protect their interest; if they cannot agree on a integer, both companies may go into arbitration; within arbitration, an neutral 3rd shindig reviews all the facts and make a final determination that is binding to both party; but arbitration like going to court take time; usually the hearings are set 6 months surrounded by advance due to backlog;
if they dont arbitrate, it is not exceptional that each side will compromise; ie; split the difference; so I don`t know the other company may agree to 85%;
now if your company is unsuccessful within negotiating the liability and accept the 70%, then you will be reimbursed your deductible by 70% or $350 and your company will receive 70% of what they salaried to repair your car; if they dont submit your rental to them for reimbursement, consequently after your company settles with them, progress to the other company for your "share" or the amount that both companies agree on for reimbursement of your rental;
just be glad you have insurance; if not, you would hold been out roughly 1K of your own money next to no recourse;
You can't collect twice, and make a profit, over one and the same accident. If your insurance covers it, they enjoy the right to go after the at bad habit company to be reimbursed. Just because they only want to adopt 70% of the blame doesn't mean they can. Let your insurance clash with them over blame. If they muddle through to collect 100% from the at fault company, you can get hold of your deductible back after.
