Hi i was involved in a auto happenstance a month ago. I was without insurance and backside ended the other person. the other party immediately admitted mistake saying he was looking down and after slammed on his brakes. (On the freeway on ramp in front of a red traffic control light) he got my information but did not tender me his. he left repeated messages stating how i wanted to "work this out". One month after the coincidence he sent me a letter saying he will report me to the DMV and Highway patrol as a hit and run. Can he still database charges against me? Is he braking the law for waiting? Is this considered extortion / blackmail? Though he admitted knock am i still at fault if he changes his mind? I thought he would database a report but since he did not should i file a police report against him and the letter he sent me? Sorry thats a of of question, odd situation, thanks everyone.
Whether or not he say it's his fault matters!
The party in the rear is other the one charged with following too closely...
He could report it at any time...telling the police you two be planning on working it out and now you are 'stiffing him'
The police will have to see proof of your ins., to see you be insd. on the date of the incident.
It doesn't look to good for you...
but the one thing that does serve your case is he did not give up his info!
The police will see that as suspicious!
Personally I would a moment ago leave it alone and fix your car yourself and suggest to him to do indistinguishable.
Niether of you want your ins. to double for the next five years.
Here in Ontario Canada, the police are in recent times looking for people driving with no ins...$5000 automatic fine!
Good luck!
Wow, first sour unless you can prove he deliberatly caused the accident or did not avoid a collision when he could enjoy done so... YOU are the responsible party in a collision where on earth you rear end someone...
You must be within control of your vehicle at all times, and part of this control is person able to stop and avoid colliding with obstacle that may suddenly appear...
If you collide with someone because they stopped suddenly, then you be following too closely...
As for leaving the scene of an accident... If they claim it be a hit and run, it obviosly was not, however, if they claim it was and that you disappeared the scene then it's your word against thiers...a hairy place to be surrounded by..He should have reported the accident immediatly and to do so immediately after 30+ days indicates you mutually agreed to take care of this past its sell-by date the books...
YOU are liable for the damages to his car, plain and simple...
Wow, increase your following distances to compensate for these problems, and at lowest get minimum liability insurance...
If you can't afford to do this, then you really shouldn't be driving.
Good luck.
YOU are 100% at blemish here. It doesnt matter if he THINKS hes at fault..
you spoilt to maintain proper distance.. your at fault.
What will arise next is this:
1) His insurance will pay for any damages to his coup¨¦ and any injuries sustained
2) They will then send you (the at imperfection party) the bill to be reimbursed.
3) if you fail to reimburse them.. multiple things will happen. Your license can be suspended.. wages can be garnish... etc
I hope you learned your lesson. People who drive uninsured are SELFISH and put us all within danger.
Unfortunately he CAN file charges against you as it's merely been a month and depending on what state you're in, the statutes of decrease can be up to two yrs. Technically you are at fault for rear climax him, even though he admitted to slamming on his breaks and he knows this. That is why he is trying to progress after you now.
I suggest you talk to him and work out a concordat and once you agreed on a settlement, put it in writing and have both of you sign it so he doesn't come after you again for more money. You don't want him reporting you or worse, suing you and since you didn't own insurance, it will all come out of your pocket.
I don't know.
Keep the missive.
Lie and say he gave you his info and you lost it.
You don't hold to stick around for the cops.
You give your name and insurance info to respectively other and then do a claim through the insurance company.
If it is a bad luck cops may come.
Do you have insurance now?
You're going to gain a ticket for not being insured. The fender bender is probably also going to be attributed your fault. You reverse ended him. 99% of the time its the person within the back that is at failing because you were following too closely. You should file a police report. Explain the situation to the police and bring responsibility for your actions. I hope you got insurance between very soon and then because it isn't going to look good if you're still acting irresponsibly and not driving insured. I wouldn't allow this stranger to hold it over your boss. You should have filed a report rapidly. Don't put off problems. They just receive bigger if you do.

I think the person who does the backside ending is almost always liable, even if the other guy initially admit fault.
I don't think in attendance is any merit to the hit and run claim, however, since you stayed and gave him your info.
You should report the accident to the DMV because near can be stiff fines for not reporting it.
It sounds to me like you may be responsible for fixing his car, but not guilty of any crime.
