Auto disaster sound out?

I had already backed out of my parking space contained by my apartment complex, when this lady hit me, while going at more than 20 mph. The thing is that in attendance were no witnesses. I was back out, but diagonally, because the spaces are to close to back out at a right angle. She hit my 2door ford probe contained by the corner of the rear drivers side.

What are the possibilities of me winning this shield?

What evidence can I gather or how can I prove this occurred when at hand were no witnesses?

PS: the speed limit surrounded by my apartment complex is 5mph.

Because It's your word against hers on weather you have backed out in front of her or not(while she be driving at a safe speed), you are going to have to amass evidence that the impact to your car was a result of her breaking the speed parameter. Or at least driving at an un safe speed which would hold given you no chance to react to her as you be pulling out/ pulled out already. If she was indeed driving unsafe then the break to your car should reflect that simply by the impact. I hope you get a police report, and documented the damage with any a camera and or video. Another thing to consider is this: Were you already driving forward when you were hit? Were you within reverse when you were hit? Was your car not within motion when you were hit? and if so were in attendance skid marks leading to the impact? If in attendance were skid marks.that is to say clear evidence of the speed of the vehicle that hit you as well. Take pictures of everything put together a written time frame, get a police report. Do not confess fault. Also I hope you have adjectives of the other persons information. Be thorough, be professional, and be polite. Good attitude opens doors contained by the face of bad intentions.

"winning the case"- what do you propose? having her company pay for your damages... extremely very unlikely.

First off... you be backing. you failed to verbs right of way.. sure.. say you be out as much as you want... but.. unless she hit your rear bumper right in the center.. proving you be all the way out of the space and nearly to move foward... you have no case. . you clearly werent adjectives the way out.

Second- how on earth do you know how in haste she was going? exactly... you dont. there is no proof she be speeding here... so you cant just go making assumptions and presume thtas gonna hold up. You cant just make up some numeral about how fast you surmise she was going.. plus.. that would mean you would enjoy had to see her coming.. if you saw her coming enough to know she be speeding.. whyd you back up?

There is proof one person did something wrong here... you have the duty to yield and you didnt.. they have proof on that... you getting hit on your backside door while backing out of a spcae..

Best defence scenario here would be yoru insurance siding with you.. and not paying her damages. BUT.. never ever in a thousand years surrounded by her insurance going to pay your damages.

Answers:    if you are going to small claims court.be well prepared..take photos.create a diagram of where on earth both cars were in relation to respectively other etc.. usually the best prepared case will win..
