I was involved in an twist of fate at my fault and the claim against me was more than my liability ceiling (release amount they call it). The other insurance agent told me that they will take the claim to their litigation department for further processing. I'm thinking that this channel litigation department will conduct a asset check on me. What is going on? Whats going to happen? I can't afford to pay the difference that they are requesting..
It doesn't matter if they do you have the legal liability insurance so you are covered. They'd have to steal you to small claims court to get any money from you and then again in attendance, theyd have the win the case and later again..they'd have to collect.
Answers: If you cause more damage than your insurance could cover, based on the limitations you chose, and you were responsible for the damage, they own a right to collect what the insurance didn't pay from you. They will take you to court, (your insurance should backing with an attorney) and if they prevail and get a pronouncement against you, they will attempt to collect what you owe. If you don't make payments acceptable to them, they can attach any assets you might own, which would include any tax refund you might enjoy coming or your paycheck if you are employed. They cannot take your primary vehicle, nor the tools of your trade if you are self employed.

That is the problem near buying low limit coverage just to draw from your vehicle registered. You are responsible for any amount of damage to property or person above the rein in of your policy. What the other insurance company will probably do is take you to court for the difference in what your insurance salaried and what the real cost is. If they get a perspicacity against you it will go into your credit history until it is paid rotten.
Where I used to work the threshold be $3500 bucks. Otherwise I'd just send the difference to collections. In any case you need to salary it. You are responsible for being underinsured and for the difference in the claim.
If you own any assets, they will sue you. It's not that scary--it's merely that if you have something to attach a lien to in establish to pay for your actions later that's what should happen.
BTW you can set up a payment arrangement...ask how much they are ready to take monthly. Failure to pay this claim could meander up in a judgement against you which could ultimately wind up at the DMV who could revoke your license.

Yes, an asset check will be run. Depending on whether you 1. have any and 2. how much the remainder of the claim is...the other insurance will want whether your claim is a good candidate for a lawsuit.Where I used to work the threshold be $3500 bucks.
