I was parkerd along side the pavement, indicating to pull out; I have checked the mirrors and pulled out... Some other vehicle came around the bend going beyond the speed limit. I hadn't see him when I checked my mirriors, so that concludes he must've be travelling very swiftly for that to happen. I hold a witness account of this too... I pulled out and my veichle went into the side of his saloon. He at the time was adamant that I claim liability, and that be that. He wasn't also going to give me his insurance details, not till I insisted I be given them. Yet, he was relatively persistent with attainment mine. There's also quite the bump on his vehicle, which was impossible for me to do at the speed I be pulling out in - which was individual about 4-5 MPH. He also wanted me to progress to the police station and claim liability... Was this my fault...?
Anytime you own an accident, especially where the slate is in question, you should send for the police and have them write an accident report. The officer will usually determine responsibility. Anytime the other person refuses to grant insurance info, you should call the police. Your description of the accident, puts him at blame. Without a police report, neither of your insurance companies is likely to pay for damages, that's why he considered necessary you to claim liability. Never claim fault, let the police determine it.
i guess it was his fault
she shouldnt of be going really fast around a corner
Never, EVER, EVER claim fault for an misfortune, regardless if its yours or not. :) And always get the other party info, even if they don't want yours!
I would say that logically it's his responsibility. Unfortunately logic and the law aren't always like peas in a pod. The traffic laws in your state determine who is at denounce. Your insurance company will send an adjuster who is familiar next to state laws to look at your car and his and later determine the fault. In my state it wouldn't matter how hasty he was going it would be considered your fault because you pulled out surrounded by front of him. It's stupid, yes, but that's the law.
You were smart to seize his info, especially when he was trying to intimidate you. Obviously, he knows he be doing something wrong and that he might possibly be at fault, which is why he was trying to intimidate you into taking responsibility. If that ever happen again, where the other driver isn't cooperating, get surrounded by your car, lock the doors and call 911. Tell them you be just in a saloon accident and that no one is hurt BUT the other driver is angry and refuse to provide his info. They will send an officer. The officer can also determine who is at fault. He will impart a ticket to the person who is, which sucks if it really is your fault, but I've see a lot of cops give the ticket to the party with the bad attitude cuz conspicuously they were probably doing something wrong to cause the disaster.
GOOD JOB ON STICKING TO YOUR GUNS AND GETTING HIS INFO, THOUGH!! GOOD LUCK!
your fault...you pulled out and hit him. doesnt matter if he be speeding, YOU hit HIM

However, the witness needs to be independent, i.e. not know you instinctively. Also, they need to be convincing in that they _knew_ how hurried the other person was going. Lastly, I've hear people say a million times that the other vehicle be speeding as they never saw it... then how did you know it was speeding? When individuals don't see a car before pulling out, they want to integer out why. They could not have just missed seeing the vehicle... no... it have to have been speeding. In otherwords, it's unlikely that the other vehicle speed will be considered as a factor in this accident. Possible... but unlikely.
The reality that you did not see him is not proof that he was speeding. It's proof that you did not see him.
You had a duty to get sure the way was clear formerly you pulled out. The way was not clear - a vehicle was coming. You did not see the car- You pulled out and hit the car surrounded by the side.
You are at fault.
your fault...you pulled out and hit him. doesnt matter if he be speeding, YOU hit HIM
Answers: First off adjectives, you never admit that is your quirk even if you know it is.
Secondly, never argue with anyone. If the person is giving you a sturdy time, you pickup your cell and call 911. No need to communicate him/her what you are doing. He/she will get the hint.
Lastly, insurance companies claim can be tricky. Most plausible they will see it is your fault because you should have be able to see him no matter at what speed.

If you can show that they other person was driving at a soaring rate of speed _and_ this contributed to the accident, there could be some liability against the other human being. It also depends on your state laws as to how this would affect the claim. However, the witness needs to be independent, i.e. not know you instinctively.
