Car insurance after a brake downfall and collision?

i was driving a dodge 2500 on the highway when here was a sudden stoppage of cars within front of me, this was regular and i hit the brakes hard, they slowed me down to 10 mph but suddenly give up stopping? i hit a mercedes in front of me and i cant afford to simply pay the soul for the damages to their car so i enjoy to go through insurance. They said the luck is my fualt , even with the brake washout. Is this right?

I have the truck within the shop getting looked at right now so i can hold a statement for my insurance company.

There is deffinatly something wrong with the brakes becuase immediately the pedal is very soft and i cannot lock the wheel or get them close to locking.

Answers:    This exact point happened to one of my clients final week in a Ford F350 or doesn`t matter what it is. If you have your brakes checked and maintain regularly and you just did not hold enough time to stop afterwards it's your fault. If your brakes go out due to a defect contained by the product then the capitalist is liable. With my client the difference was that a couple of days back the accident his motor was at the provider getting his brakes and in the calamity his anti-lock brakes did not lock in. I would directory a claim and let the adjuster know that the brakes seem like they go out, its up to him if he is going to determine the accident to show as remiss or fault free.

Even if it's a powered failure, it is your show disapproval. It was your truck that hit the Mercedes. Your insurance will rate. I think your rates will run up even if the truck had a powered failure.
