You can filch the insurance money, but make it clear that you are not happy beside it and then take the other driver to court for any money inc expenses that you reflect you are entitled to.

a small claims court is for claims under lb5,000. And YES it is worth it, because if the other person does not turn up you will win by defaulting

Answers:    In the UK no insurance company will pay for repairs if the costs are too high compared to the helpfulness of the car. There are a few options, possibly agreeing a valuation next to your insurers and asking to buy the salvage back so you could repair it (this is entirely up to your insurers) but the car would still be registered as a write sour and most insurers would require a new MOT to insure it.
With regards to valuation, its not a skin of issuing summons, it would be filing a complaint against your insurers - they would more than likely ask you to provide evidence such as advert so its no good expecting an unrealistic figure. If you still remain depressing they would direct you to the FOS (Financial Ombudsman) who would deal with your complaint. It is also unlikely the other partys insurers would increase the submission much above what you own have offered as all companies pretty much use equal source (Glasses Guide etc).
Hope this helps.

In the U.S. Here, you are not required to accept their offer. You can dispute it and thieve to to court or mediation. I had the same issue. The offered me roughly speaking half of what similar cars were selling for. I told the insurance company, "I don't want to, but if I enjoy to, I'll hire an attorney to get what I think my coupé is actually worth." About a week later, I received a communiqué to sign. They offered me what I was originally asking for. I signed the letter and thy sent me a check.
