Can i sue the responsible group for...

Answers:    You won't go to jail, debtor's prisons be done away with in the 1800's. But you and your mother in a minute owe the party that was hit the cost of any repairs or the fair market efficacy of their vehicle, whichever is the lessor amount.

Chances are the other party has uninsured motorist coverage on their policy, which will cover their losses, but once their insurance settles next to them they will be asking you and your mother to pay them back from what they compensated out. If you don't you will be sent to collections and your credit rating will plummet.

I don't normally suggest involving attorneys, but in your skin I think I would ask a competent attorney what you can do.
