So i was involved in a hit and run and the satchel has been solved, the celebration does have insurance, the claims rep told me a month later since i don't enjoy collision coverage (being at fault apparently doesn't matter which i thought it did) they can't pursue this and contact the people insurance company, it just bugs me that they took a month to get put money on to me and it wasn't until I had called their supervisor that i get a call back like day. I'm just curious what you guys would suggest, should I contact his insurance company directly and see what can be done, my insurance company is aphorism i should try and take him to small claims court, he admits to anyone intoxicated and hes definitely at fault within the police report statement so what would you guys do? Take him to small claims court or talk to his insurance company, I would prefer to not go to small claims court but if i hold to then ill do that

Answers: Since the other carnival does have insurance, you should try to go through them first and put surrounded by a claim. Hopefully the other driver has collision coverage. The only time you should be in motion to small claims court is if his insurance won't pay up or if his coverage isn't sufficient to cover your damages. In that case, you will enjoy to sue him for the difference.
