Answers:    This shows 2 things. $10,000 liability is crap insurance. Anybody who carry legal minimums is an idiot, who will kill or injure somebody someday, and finishing up losing a huge lawsuit. It also shows the danger of not carrying collision and comprehensive on your car. If you, or anybody, can afford to accomplish into your pocket and replace your vehicle, you don't need to carry full coverage, you clutch your chances. If you cannot afford to pull out the wallet and buy another motor, you cannot afford to drive without full coverage. You have your $2500, will capture another $2300 or so, and you can sue her directly for more, with no guarantee of getting anything. With your own insurance, you would have have your car repaired, and the insurance company, if they couldn't collect any more, would eat the loss, i.e. what insurance premiums pay for. Unfortunately, you have put yourself surrounded by a hole, and will likely have to replace your vehicle with a much less expensive one, unless you lift out a loan. As far as settlement goes, time depends totally on local law. You enjoy done your part by putting in your claim.
