my inlaws were driving down a country road at dark in reduced vissibility( fogg approx 300-400 yrds viz), as they rounded a corner the fogg appeared to gain worse, so they slowed, unfortunately a vehicle have colided heavily with a tree, and be completely blocking the road,(the fogg was in reality smoke and steam from that vehicle). They were on their side of the road, but be unable to avoid hitting the vehicle as it completly blocked the road. Their vehicle come to rest immeadiatley on the correct side of the carriageway. The police were surrounded by attendance rapidly, and contained by fact an stale duty police man was the subsequent vehicle along. It is a high possibility that the driver of the other vehicle be under the influence following a roadside breathtest.
From an insurance claim perpspective are they competent to pursue the other drivers insurance company for the considerable damage to their vehicle

Answers:    I'd say it is notably unlikely , having have a similar experience from someone hitting my car contained by fog and saying I should not own been in attendance - my car be broken down in the middle of the road and apparantly I should hold pushed it to the side of the road. By myself. In nil visibility fog. My insurers quite rightly told them to take lost when they tried to claim against me, and in reality I was successful contained by a counter claim. I was told by legalized services that if visibility is reduced one must slow to a speed which will ensure that you can brake within the visibility limitations, taking into account the fog AND any other circumstances (inc corners, smoke etc). If that technique you have to stop, after you have to stop. The reality that the other driver may or may not have be drunk (how do you know there is a 'dignified possibility' - are you privy to the police reports?) is entirely irrelevant, your inlaws would still have hit him have the accident resulted from him losing control for a non-alcohol related root. In fact they in a minute need to be concerned that they may finish off up liable for damage to the other person's sports car (assuming he can prove that it was not cause by the original prang....)

Sorry, but if the other vehicle be stopped for any reason, and they run into it, they were driving too promptly for conditions and will be found at fault. They slowed, which be good, but noticeably didn't slow enough to know how to stop and avoid an accident.
