My 125cc ducar engined mini bike is...
This is a fairly common problem next to many bikes and ATV's. If a bad shift is made a couple of times, the adjectives dogs/holes on the gears get rounded off, so the gears tend to cam themselves out of engagement beneath load. This damages the shift fork, and cam/drum. A stronger detent spring, when the vehicle is new may prevent pull, BUT IF IS ALREADY JUMPING OUT, can cause more serious damage. New or undamaged gears may hold their contact faces back cut, to "lock" them within engagement when under power. This makes clutchless shifting a bit different, but next to practice, you can manage it. And it will stay in gear lower than load. A slightly damaged gear can be repaired indistinguishable way, but the shift forks should be replaced at the same time, and the drum/cam plate, it it have any damage. The back adjectives can be done by a machine shop, or by a very mean chap with a die grinder, and carbide burr. Actually, within my experience, the better jobs are done, very vigilantly, by the chap with the die grinder. Do not try it yourself, unless you are an artist, or hold a lot of die grinder experience.

Answers: You mean it's a hard shift or that it in fact comes out of gear? A hard shift just resources you need to pay more attention to when your shifting gears but if it's popping out after take it in.
