My daughters car be rearended at a light. The police come and took a report and everyone showed proof of liability ins. No citations were issued and both vehicle drove away. Now we find out that the proof of ins. the other driver showed was not valid any longer because he have not paid his premium for that month. Are we stuck beside the bills or do we have any recourse, short of going to small claims court? Since that does undeniably no good within Tx. since payment is not inforced surrounded by any way.
Answers: If you enjoy either collision coverage or uninsured motorist coverage, report a claim with your own insurance company. You should carry paid eventually, but may frontage a deductible and/or an increase in your premiums.
You could report the other driver to the DMV and/or the police for driving minus insurance, but that will not get you the money.
I would put within a call to the reporting officer. At the amazingly least perchance the other driver can be ticketed for no insurance.
