My friend got into an coincidence this morning and here is what happened.
He be in the vanished lane on the Northern State Parkway. Another car oblivious to him starts to in the blink of an eye cut him off. He jam on his breaks and his car starts to weave. The other sports car doesn't speed up enough for my friend to straighten out his saloon in the lane and he is forced to choose from one of the 3 scenerios:
1- Rear finishing the car that cut him bad
2- Side swipe the car contained by the right lane
3- turn toward the divider
he knew if he reverse eneded the first car or side swiped the other coup¨¦ he would automaticly be at fault so he hit the divider.
The just damage is to his bumper and he be able to purely scrape along the divider and preserve going. He chased the car to try to procure the person to verbs over but she refused. He took her licence plate number and label, model and approx year of the car. (he does side work within a mechanics shop)
Is the other person at reprimand for the accident?
Well DUH!
did he report a police report?
Your friend. Driving laws state that a driver must be contained by 100% control of the vehicle at ALL times. Doesn't matter if in that is ice, deer, 1000 geese, someone adjectives you off or someone pulling a "NY"(Butt contained by line by adjectives into your line so you must agree to them ahead of you.)
And chasing the other car? That's ONLY for the police.
Answers: The other driver is at error. However, your friend made the wrong choice. There is no way to ever prove the error of the other driver. All she has to do is show up within court and say no, and no charges will be file against her.
Your friend should have smashed her contained by the rear. He would enjoy to prove that she made an unsafe land metamorphose, but that would be much easier than how it is now.
His individual hope is if there be a witness.
