If someone be crossing the street (jay-walking) and they got hit by a sports car, whose fault would it be? The pedestrian because the didn't use the crosswalk? Or the motor because they weren't watching?
This hasn't happened to me, but I only wanna know whose fault it would be.

The pedestrian has the right of opening. If a pedestrian walks out surrounded by front of a car suddenly, and the pedestrian dies after individual struck, then the driver can be tried for forgetful homicide, which is a felony in the third point.
