One car is traveling slower than the speed hold back on a road that is freshly covered contained by snow. Another car who is surrounded by a blind driveway backs out contained by reverse. There is limited visibility. The vehicle on the road going on average 20-30mph slams on the brakes at a far distance (determined by skid tracks surrounded by the snow), the ABS kicks surrounded by but to no avail hits the car coming out of the driveway. The being coming out of the driveway claims the other driver was speeding, the other event denies it and blames it on the slippery conditions. That same night plentiful other accidents happen because of the snow and limited visibility. Who be in error within this accident?

Answers:    Lets put this contained by to perspective. I'm in my coupé driving down a snow covered road and you are backing out of your driveway. I don't regard as a veteran Police Officer this is a hard cross-question to answer. I live in VA and nearby is a code that states you must yield the right of route to oncoming traffic in the street when pulling from a private driveway. See below.

§ 46.2-826. Stop beforehand entering public highway or sidewalk from private road, etc.; yielding right-of-way.

The driver of a vehicle entering a public highway or sidewalk from a private road, driveway, nouns, or building shall stop immediately up to that time entering such highway or sidewalk and yield the right-of-way to vehicle approaching on such public highway and to pedestrians or vehicles approaching on such public sidewalk.

Whoever pulled our of the driveway is at failure. There is no way a referee would rule in favor of the driver from the driveway for a couple of reason:
1. Why would you pull out contained by front of a speeding car?
2. You can't peacemaker the speed of a vehicle just by looking at it.
3. It's approaching any other intersection the vehicle already i the road has the right of course.

well the motor going down the road obviously have the right of way over someone funding out of their drive way.... wtf be the people protection out of their driveway thinking? what, everybody should stop for them?
